19-year-old boy from India faces criminal charges after starting a community on Orkut against Shiv Sena (a political party that predominantly supports Hindu Nationalist Agenda). The community had several posts and discussions by anonymous persons who alleged that Shiv Sena was trying to divide the country on region and caste basis.

While the accused pleaded that the comments made on the community were mere exercise of their fundamental right to freedom of expression and speech and could not be treated as an offence however, the court is unimpressed and won’t quash the criminal proceedings.
