Is US court’s decision to ban death penalty for child rape justified?

The Supreme Court of United States declared on Wednesday that executions are too severe a punishment for raping children, despite the ‘years of long anguish’ for victims, in a ruling that restricts the death penalty to murder and crimes against the state.

The decision is a shock for many, who believe that such punishment deters others. On the other hand, many human rights activists opposing death penalty are rejoicing. Human Rights and other activists believe that human life is too precious, doesn’t matter how corrupted it may be. Every man should be given a chance to recover or live his life, why not behind the bars.

Can never be justified. What message is the US court trying to convey? You can molest a child and get simply imprisoned for that. I guess God’s not in His Heaven and every thing’s wrong with the world.

if a child gets raped, it scars him for life and for him or her it must be like being dead from that point onwards...

when you put an end to someone’s life, you should not be allowed to live on yourself...

when you dont respect someone else’s human rights you shouldnt be allowed any yourself

What if the wrong person gets convicted ? This happens all the time. I am all for sufficient punishment for perpetrators but you have to make sure you have the right person and if you really want revenge/to-make-the-perp-suffer, a lifetime in an American prison (where some of the most rapacious jails in the world exist) would be a lot worse than death...

Capital punishment is not the answer for any crime. However unkind that might sound, death penalty must be abolished unconditionally. I think Europe has a lower crime rate than the countries that still have capital punishments... That doesn’t mean the guilty in Europe get away!!!!! Somehow European laws without the death penalty seem to deter perpetrators, talking about efficacy of such laws.

Death penalty is no penalty at all. It is just a form of emancipation. I am also dead against any form of corporal punishment. Twenty five years behind bars and five years of community service is sufficient for even the most heinous of crimes including child rape, terrorism and murder.

I am disgusted to see Nishi Roy's mindset. Such thoughts within societies are dangerous for they suggest a criminal bent of mind in a different way.

Death penalty is for barbaric countries. It has no place in today's world. Those countries still practice death penalty are the most unsafe countries. USA is a very dangerous place. There are more murders in USA than the whole of Europe combined where there is no death penalty.

We must understand the difference between revenge and punishment. By putting a man to death are we punishing him or we taking revenge upon him for what he did? This is a strange mindset really. I can never support death penalty for any crime.

Death sentence is sometimes very important to maintain the smooth running of the society. A man fears for his life the most. Every single person in this world is afraid to die. If the fear is taken out of the heart of potential criminals there would be more crime. Child rape is an extreme crime. The perpetrator should be removed from the society.

P.S. I am not taking about those crazy suicide bombers though.

Justified??? More than that. Why?

a) The rapist after raping would be inclined to kill the child for there would be no incentives in keeping the child alive after raping her.
b) Sex with minors like having sex with anyone under the age of 16 in some states constitutes statutory rape. If a 17 year old guy has consensual sex with a 16 year old girl he would face death penalty if the girl wishes to file a case. And with the kind of forensic technology available today there would be no escape.

Total nonsense. I am glad that the proposal has been snubbed by the Supreme Court.

Death sentences are never and can never be proportional to any crime, not even in the form of retribution that some members of the society seek for child rapists, murderers etc. It's totally shamelessly disgraceful.

We pay taxes. Tax money is used to investigate, prosecute, try and punish a criminal. What's the purpose of this? The primary purpose is to reform the criminals and bring them back to the mainstream society. This is the reason we pay for their lodging and food in jails. With death penalty, this very objective is defeated. We spend, we try and we kill a person. What purpose does it solve? Does this bring down the number of crimes that warrants death penalty? The answer is NO.

A question for all those who advocate against death penalty, I am sure many of whom haven't had any brush with criminals.

What would your first reaction be if you happen to know that a close member of your family is senselessly murdered, a female of your house is raped or even your child dying in an accident crushed under the wheels of a school bus?

Without any doubt, you would first like to see the blood of the murderer, the rapist or even the driver of the school bus. Isn't it?

Capital punishment for many crimes is justified. In India we have reserved it for the rarest of the rare kind of murders. I believe it should be extended to rapes, drug trafficking, corruption and armed robbery.

Child rapists are mentally sick people who need psychiatric treatment and not any punishment. No one would rape a child unless the person is mentally sick. We have also seen that many such criminals have had histories of child abuse themselves as kids.

Sometimes the courts should take into account the public sentiments. This is no judgment. After all lawmakers make laws and the courts shouldn't intervene in between. If a majority wants such criminals to be put to death, so be it.

What else do you think would be an adequate punishment for them? I don't think any one here seriously believes that such people can be reformed through a term in jail and they would come out as priests. I don't remember the name of the fella, a sexual offender in prison who had been pleading the government for ages to castrate him because he knew that he would go back molesting and raping again for which he was convicted once he is out of the pen.

Rape victims must show more compassion towards their rapists. They must be given a second chance because after all it is just a sexual act. Nature has made animals to have sex and only we humans have put all kinds of restrictions around us to have sex freely as nature mandates us to do. The best punishment for rape would be to force the rapist to marry his victim and if the victim is a minor then he must marry when she is old enough to get married. This is the best possible solution.

Justified my foot! People who say capital punishment is retribution and not punishment may be right. Let's put those scums to sleep and root them out of our society so that they can be punished by God when they reach hell. Let's leave the punishment to God because we are too insignificant to punish such criminals.
